These Terms & Conditions (the “Terms”) govern your access to and use of embroideryhoopstore.com, including its content, features, tools, products and related services (collectively, the “Services”). Throughout these Terms, “Embroidery Hoop Store,” “we,” “us” and “our” refer to the operator of the Services, and “you” and “your” refer to any visitor, customer or other user of the Services.

By visiting, using or purchasing through the Services, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy, Refund & Return Policy, Shipping Policy and Payment Methods. If you do not agree, do not use the Services.

Important product notice: Magnetic embroidery hoops contain strong magnets and can create pinch, impact and magnetic-field hazards. Review Section 4 before purchasing or using a magnetic product.

1. Eligibility and Accounts

You must be at least the age of majority in your place of residence to make a purchase. If you permit a minor to use a device or account you control, you are responsible for that use.

You agree to provide accurate, current and complete account, billing, payment and shipping information. You are responsible for safeguarding your login credentials and for activity carried out through your account. Notify us promptly if you suspect unauthorized access. You may not sell, transfer or assign your account.

2. Product Information

We make reasonable efforts to display product descriptions, dimensions, photographs, specifications, colors, packaging and availability accurately. Actual colors and appearance may vary because of screen settings, manufacturing tolerances and product updates. Measurements may be approximate unless expressly stated otherwise.

We may update, modify or discontinue a product, specification, price or offer at any time. Images and videos may show accessories, machines or props that are not included. The contents of your purchase are those expressly listed on the applicable product page or order confirmation.

3. Machine Compatibility and Customer Responsibility

Embroidery-machine compatibility may depend on the machine brand, model, series, sewing field, arm spacing, bracket, mounting system and software settings. Similar-looking machines may require different brackets or hoop configurations.

Before ordering, you are responsible for checking the full machine model and the compatibility information on the product page. If compatibility is unclear, contact us before purchase and provide the machine brand, complete model number and, when requested, photographs or measurements. Unless we expressly confirm otherwise in writing, general brand references do not guarantee compatibility with every machine produced under that brand.

Before stitching, install the product according to the supplied instructions, verify secure attachment, confirm the usable embroidery area, and perform the machine manufacturer’s recommended trace, frame check or low-speed test. Make sure the needle, presser foot and machine head will not strike the hoop, bracket or garment. We are not responsible for damage caused by an incorrect model selection, improper installation, use outside the stated embroidery area or failure to perform appropriate clearance checks, except where liability cannot lawfully be excluded.

4. Magnetic Product Safety

Magnetic hoops and magnetic accessories contain strong magnets. By purchasing or using them, you agree to follow all product instructions and reasonable safety precautions, including the following:

  • Keep fingers, skin and loose items clear when bringing magnetic components together. Sudden attraction may cause pinching, crushing or impact injury.
  • Keep magnets away from children and pets. Small or detachable components may present choking or ingestion hazards. Swallowed magnets can cause severe internal injury and require immediate medical attention.
  • Strong magnets may interfere with pacemakers, implanted cardioverter defibrillators, insulin pumps, hearing implants and other medical devices. Anyone with an implanted or body-worn medical device should consult the device manufacturer and a qualified healthcare professional before handling or approaching magnetic products.
  • Keep magnets an appropriate distance from magnetic storage media, payment cards, watches, compasses, precision instruments and other items that may be damaged or affected by magnetic fields.
  • Inspect the hoop, magnets, coating, brackets and fasteners before each use. Stop using any item that is cracked, loose, deformed, corroded or otherwise damaged.
  • Use products only for their intended embroidery-related purpose and in accordance with the embroidery-machine manufacturer’s instructions.

5. Orders and Acceptance

Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may accept, reject, limit or cancel an order for legitimate reasons, including product unavailability, suspected fraud, payment authorization failure, pricing or description errors, shipping restrictions, or quantities suggesting unauthorized resale.

If we cancel an order after payment has been captured, we will refund the amount paid for the cancelled portion to the original payment method. Please review your order carefully before submitting it. We may be unable to change or cancel an order after processing begins.

Products may be purchased for lawful personal, household, professional or business use. Unauthorized resale, unlawful export and purchases for prohibited purposes are not permitted.

6. Prices, Payment, Taxes and Duties

Prices, discounts and promotions may change without notice. The amount charged will be the amount displayed at checkout and confirmed in your order confirmation, subject to correction of obvious errors as permitted by law. Currency conversion rates and fees applied by your card issuer, bank or payment provider are outside our control.

Unless expressly stated otherwise, product prices exclude shipping charges, customs duties, import taxes, brokerage fees and other government charges. You are responsible for charges imposed by the destination country or region. Available payment methods are described on our Payment Methods page and may vary by location, device or eligibility. Third-party payment or buy-now-pay-later providers may impose their own terms.

7. Shipping and Delivery

Shipping destinations, processing times, estimated transit times, tracking and customs information are described in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Carrier delays, customs processing, address errors, severe weather and other events outside our reasonable control may affect delivery.

You are responsible for providing a complete and deliverable address and for monitoring tracking updates. Contact us promptly if a package is delayed, lost, damaged or marked delivered but cannot be located. Risk of loss and title pass as provided by applicable law; nothing in these Terms overrides any mandatory consumer protection applicable to delivery.

8. Returns, Refunds and Exchanges

Returns, refunds, exchanges, damaged items and incorrect items are governed by our Refund & Return Policy. At the time these Terms were last updated, eligible unused items could generally be returned within 30 days of receipt after obtaining return authorization. Because the policy may be updated, please review the version in effect when you order and contact us before sending any item back.

Do not return products to the address shown on a shipping label unless we expressly authorize that address. Your statutory rights, including rights relating to defective or misdescribed goods, are not limited by this section.

9. Limited Product Warranty

Any express warranty is limited to the warranty stated on the product page, in the product documentation or in a separate written warranty supplied with the item. Unless an express warranty states otherwise, warranties do not cover ordinary wear, cosmetic changes that do not affect function, misuse, improper installation, modification, accidents, corrosion, exposure to unsuitable conditions, use with an incompatible machine, or failure to follow instructions.

To request warranty support, contact us with your order number, machine model, a description of the issue, and clear photographs or video. This section does not exclude warranties or remedies that cannot be excluded under applicable law.

10. Intellectual Property

The Services and their original content—including text, graphics, photographs, videos, logos, page design and software—are owned by or licensed to Embroidery Hoop Store and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for lawful shopping and informational purposes.

Without our prior written permission, you may not reproduce, republish, distribute, sell, license, modify, scrape, systematically extract or commercially exploit any part of the Services, except as permitted by applicable law.

11. Third-Party Brands

Names and marks of embroidery-machine manufacturers and other third parties—including Brother, Baby Lock, Tajima, Melco, Ricoma, Barudan, HappyJapan, SWF, Janome, BAI and ZSK—belong to their respective owners. References to those brands or machine models are used solely to describe intended compatibility. Unless expressly stated, Embroidery Hoop Store and Sewtalent products are not sponsored, endorsed by or affiliated with those third-party brand owners.

12. Reviews, Feedback and Other Submissions

If you submit a review, photograph, video, comment, suggestion or other material (“User Content”), you retain any ownership rights you have and grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, reproduce, adapt, translate, publish, display and distribute that User Content for operating, improving and promoting the Services, subject to applicable law and our Privacy Policy.

You represent that you have the rights needed to submit the User Content; that it is accurate to the best of your knowledge; that any incentive or material connection is properly disclosed; and that it does not infringe rights, violate law, contain malicious code, or include unlawful, abusive or misleading material. We may moderate or remove User Content where permitted by law, but we are not obligated to do so.

13. Prohibited Uses

You may not use the Services to:

  • violate any applicable law, regulation, trade restriction or third-party right;
  • commit fraud, impersonate another person, submit false information or interfere with another customer’s use;
  • upload malware, probe vulnerabilities, bypass security, or disrupt the Services or connected systems;
  • send spam, harvest personal information, or conduct unauthorized scraping, data mining or automated extraction;
  • reverse engineer or attempt to derive source code except where such restriction is prohibited by law; or
  • use the Services or products for any unsafe, unlawful or unauthorized purpose.

14. Third-Party Tools, Links and Services

We do not control and are not responsible for third-party content, practices, availability or services, except to the extent applicable law provides otherwise.

15. Shopify

Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services. Purchases from this store are transactions between you and Embroidery Hoop Store, not Shopify. Shopify may process information relating to your use of the Services as described in our Privacy Policy and Shopify’s own privacy materials.

16. Privacy

Our collection, use and disclosure of personal information are described in our Privacy Policy. By using the Services, you acknowledge that information may be processed by us, Shopify, payment providers, shipping partners and other service providers as necessary to operate the store and fulfill orders.

17. Errors, Availability and Changes to the Services

We may correct information, update the Services, limit quantities or cancel affected orders as permitted by law. If we cancel an affected paid order, we will refund the amount paid for the cancelled portion.

18. Disclaimer of Warranties

To the maximum extent permitted by law, and except for any express written warranty we provide, the Services and website content are provided “as is” and “as available.” We do not warrant that the website will be uninterrupted, secure or error-free, or that every item will be available. General articles, tutorials and support materials are informational and do not replace your machine manufacturer’s instructions, professional training or safety guidance.

Nothing in these Terms excludes, restricts or modifies a guarantee, warranty, condition, right or remedy that cannot lawfully be excluded, restricted or modified.

19. Limitation of Liability

To the maximum extent permitted by law, Embroidery Hoop Store and its owners, affiliates, officers, employees, agents, contractors, licensors and service providers will not be liable for indirect, incidental, special, punitive or consequential loss, or for loss of profits, revenue, business, opportunity, goodwill or data, arising from or connected with the Services or products.

Where liability may lawfully be limited, our aggregate liability arising from a product or order will not exceed the amount you paid for the product or order giving rise to the claim. These limitations do not apply to fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence where liability cannot be excluded, or any other liability that applicable law does not permit us to exclude or limit.
